Résumé
Ruwen Ogien, en préconisant son minimalisme moral, a bien raison de rejeter la notion de devoirs envers soi tout en exonérant toute pratique sexuelle consentante et autres « crimes sans victime ». Mais il ne va pas assez loin. Toute moralité, à l’instar de toute religion, est intrinsèquement totalisante. Limiter son empire risque d’exiger des avenants ad hoc, greffés sur les principes fondamentaux qu’invoquent l’un et l’autre des systèmes de morale qui s’affrontent. Ce qu’il faudrait faire, c’est se dispenser tout à fait du discours moral. La fonction de celui-ci n’est que de privilégier certaines raisons pour en faire des raisons-atouts en vertu de leur caractère supposé « moral ». Or, nous ne sommes capables ni de nommer sans ambiguïté ces raisons-atouts ni de justifier le privilège en question. Se passer du langage de la moralité n’exige aucun sacrifice des bonnes raisons d’agir dont nous disposons déjà. Sans la morale, nous éviterions de nous égarer dans des disputes sans issue sur son fondement; nous n’aurions à perdre que la jouissance perverse que nous procure le droit de blâmer tant soi-même que les autres.
Abstract
The moral minimalism recommended by Ruwen Ogien is right to reject the notion of duties to oneself, while exonerating consensual sexual practices of all sorts as well as other “victimless crimes”. But Ogien does not go far enough. Every system of morality, like every religion, in inherently totalizing. To contain it may be impossible without some arbitrary limitations, grafted onto the foundational principle invoked by one or another of the available systems of morality. Better to dispense entirely with the discourse of morality, which is essentially a practice of privileging certain classes of reasons. Those reasons supposedly trump all others because they are labeled “moral”. But we can neither identify the class unambiguously nor justify the privilege we accord it. Without talk of morality, all our valid reasons to act would remain the same; we would avoid getting lost in endless foundational disputes; and all we have to lose is the dubious pleasure of feeling righteous about piling on blame both on self and others.
