INTRODUCTION

This article submits a conceptual framework for the analysis of job satisfaction. It seems clear, from an extensive review of literature (see Dunnette and Kirchner, Evans, Hinrichs, Larouche, Locke, Schwab and Cummings, Wanous and Lawler III¹), that there is a serious gap at this theoretical level. In order to fill in thisdeficiency, the authors adopt the organismic model of analysis. Some of the pioneers of this school of thought (see Goldstein, Maslow and Rogers), view man as an entity interacting with many environments, the work situation being an important one. Based on this assumption, the present analysis will proceed through four major steps before formulating a conceptual definition of job satisfaction.

ORIGINAL MODEL

After reviewing some of the job satisfaction definitions available (Beer, Ivancevich and Donnelly, Lofquist and Dawis, Smith, Kendall and Hulin, Vroom), it appears difficult to find a common denominator. To cope with this problem, the authors propose a first model of analysis which permits to clarify some of the terms currently used, such as motivation, stimulus, and other variables related with the concept ob job satisfaction.

The main interaction of the first model (see Figure 1) describes the relation-ship between the individual and his job. Taking into account the theory of Work Adjustment (see Lofquist and Dawis), one can characterize the individual by two main sets, his needs and skills. The human needs provide the energy available for action while the skills refer to the tools used by the individual in order to fulfil his needs. The concept of skills takes form through intelligence, memory and perceptual system. On the other hand, the concept of human needs includes what has been called the primary and the secondary needs, i.e. the physiological and the psychological needs. In the same trend, the other term of this basic relationship, the job, is also viewed as a two-dimensional construct, i.e. the requirements and the incentives. The job requirements represent all the comportmental requests that are considered relevant by the employer to fulfil the job adequately. The incentives are the material and psychological objects that are sent back to the employee through his job. For example, wages, working conditions, social status, autonomy, self-esteem and interpersonal relationships can be viewed as some of the major dimensions of this concept.

In this connection, the concept of job satisfaction raises up from a worker's subjective evaluation toward the adequacy of his job incentives in order to fulfil the needs he experiences. The use of the term job satisfaction implies an end of action, a result of the interaction human needs — job incentives. The use of the term motivation rather implies a beginning of action, a state of activation of the organism to find out an appropriate mean in order to eliminate the experience need.

THEORY OF HUMAN NEEDS : RÉTROSPECTIVE AND PERSPECTIVE

Two main series of coordinates (human needs and job incentives) emerge from the initial model of job satisfaction. This second part begins with a summary of the so popular initial theory of Maslow (1954) on human needs (Hogue, Huneryager and Heckman, Leavitt and Pondy, Muller and Silberer, Van Hoorick, Vroom and Deci). As it is known, this theory postulates the existence of five levels of human needs structured in a hierarchical order (see Figure 3). Maslow states two basic principles concerning the human motivation. First, he asserts that all needs are virtually present in the human being. Secondly, needs of a superior levelwill become active and « motivators » to the extent that the adjoining lower level needs are gratified. This sequential pattern is currently referred to as the prepotency process.

In spite of its wide acceptance and utilization, this theory is not supported by the few empirical tests we may refer to (Alderfer, Goodman, Hall and Nougaim, Lawler III and Suttle, Payne). According to these results, one should rather turn to Maslow's (1968, 1970) revised theory. In this new version, Maslow advances a new typology of human needs : those linked to deficiencies of the organism and those associated with the growth of the organism. The prepotency process still operates in this new classification but we cannot predict which superior needs will become salient once the deficiency needs stop acting as motivators or once they are sufficiently gratified. By way of consequences, this model allows to take into account individual differences when measuring the relative importance of human needs in empirical studies of job satisfaction.

THE INCENTIVES ASPECT

Discussing the role of the incentives in a work situation requires a resort to a human behaviour framework which allows a comprehensive explanation of the human dynamic. The authors of this paper have selected an expectancy model (see Figure 4) congruent with the major theoretical foundations already used. The framework begins with the perception of an organic need through some internal stimuli. These signals set in motion a state of activation (motivation) ; the individual then seeks actively for an appropriate mean (behaviour) to gratify his need which, when gratified, allows him to « feel good » (expected outcome). In short, the chosen model relies on the organismic approach. This construct displays a variety of behaviours which can be equated to different forms of responses. Thus, the authors do not support the mecanicist explanation of the S >R behavioural scheme because the individual is able to use his differential skills to attain the expected result. Finally, the expectancy model integrates two operational notions previously described by Vroom. These notions, valence and expectancy, prove to be very useful in a framework of dynamic behaviour, because they offer a mode of understanding one's personal way of reaching the expected outcome. When applied to the work situation, the job held becomes a primary mean of need fulfilment on account of its social value. As far as the concept of incentives is concerned, it is identified with all the possible outcomes linked to the occupationnal behaviour.

The next step consists in categorizing the work incentives in accordance with the two-level human needs analysis. The two-factor theory (Herzberg, Mausner and Snyderman) proves to be of importance for this purpose. Without discussing further the validity of this theory, save the use of the critical incident technique in collecting data, we shall limit ourselves to the dual categorization of factors the theory advocates. The extrinsic factors or incentives pertaining to the external work conditions, involve : wages, fringe benefits, security and seniority policies, etc. In parallel, the intrinsic incentives refer to the content of the task in itself, such as opportunities for promotion, responsibilities connected to the job, feelings of self-actualization, etc. For the purpose of this study, this dichotomy allows an harmonious matching between both typologies, needs and incentives, on account of their complementarity.

JOB SATISFACTION MODEL : A DYNAMIC PERSPECTIVE

The illustration of the pairing between needs and incentives is shown in Figure 6 under the heading of « inactive framework ». This model would remain useless if a corner-stone was not found upon which dynamic relationships between its components could elaborate. Wolfs need gratification theory puts forward the elements necessary to a dynamic process. More specifically, three cases can be depicted to show the operationality of our job satisfaction/dissatisfaction model (see Figure 7). The three underlined cases permit to bridge the gap between the divergent results concerning Herzberg's theory and also to develop a conceptual definition of job satisfaction, centered on human needs.

CONCLUSION

In conclusion, job satisfaction can be defined as a worker's affective result toward his work roles. This outcome stems from the dynamic interaction between two sets of coordinates : human needs and work incentives. Hence, the worker will feel satisfied or dissatisfied in his work, depending upon the adequacy or the discordance between his perceived needs and the work incentives.

Cet article veut être une tentative d'explication des grèves sauvages dans l'industrie manufacturière au Canada. L'auteur assimile ces grèves aux phénomènes de plus en plus nombreux qui consistent dans un processus par lequel des personnes, encadrées dans une institution qui leur devient de plus en plus insupportable, la rejettent et recourent aux moyens du bord pour changer la situation.

En ce sens, la grève sauvage serait la réaction spontanée et inorganisée des travailleurs contre les organisations syndicales institutionnalisées. Depuis que les syndicats se sont donné des structures, qu'ils ont mis au point des mécanismes pour résoudre les problèmes professionnels, sociaux et économiques des travailleurs, qu'ils sont devenus de vastes organisations, est-ce qu'on n'assisterait pas à la croissance des grèves sauvages ? Est-ce que, avec le temps, les organisations syndicales n'auraient pas perdu le sens des intérêts les plus importants de certains groupes de leurs membres, d'où la naissance de conflits résultant d'appréciations diverses des fins recherchées : responsabilité et militantisme, buts éloignés et buts immédiats ? Est-ce que le syndicalisme ne se serait pas trop bureaucratisé à mesure qu'il croissait ?

Mais une première question se pose : quelle est l'importance des grèves sauvages au Canada ? Il n'y a pas de statistiques sur le nombre des grèves sauvages au Canada. Pour essayer de les découvrir, il faut procéder par voie de déduction. La première caractéristique d'une grève sauvage, c'est qu'on peut la considérer de courte durée. Les grèves de courte durée (cinq jours ou moins) ont subi au Canada une courbe ascendante marquée de 1956 à 1966, puis elles ont beaucoup diminué par la suite pour faire un nouveau bond en 1969. Mais on ne peut affirmer que toutes les grèves de courte durée sont des grèves sauvages. Comme autre caractéristique, on pourrait soumettre que les grèves sauvages se produisent en cours de convention. Mais, encore là, il est certain que toutes ces grèves ne sont pas des grèves sauvages.

À défaut de renseignements satisfaisants, force est donc de se rabattre sur une analyse sociologique. Sur ce point, l'auteur estime que la grève sauvage ressemble à d'autres phénomènes de même nature qui se présentent dans d'autres secteurs de la société par le rejet des canaux normaux et institutionnels pour la solution de problèmes collectifs.

The Ontario Longitudinal Study of Aging 1959-1978 interviewed 1,214 male employees at ages 48 and 54 on attitudes towards retirement, a suitable retirement age and views on not working. Replies at both ages are examined as well as some of the conditions which may have influenced attitudes towards retirement at age 54. Chi-square analysis indicated more employees were favourably disposed to retirement at age 54 than at the earlier age. Income level alone, of four factors studied, was positively related to attitudes towards retirement.

Une étude du Ministère des affaires familiales et sociales de l'Ontario sur le vieillissement qui, commencée en 1959, ne se terminera qu'en 1978, a pour objet de connaître les changements sociaux, psychologiques et dans l'état de santé qui se produisent en cours de vieillissement ainsi que les adaptations qui y sont inhérentes. Deux mille travailleurs ontariens de 45 ans se sont prêtés à partir de 1948 à cette enquête d'une durée de vingt ans.

Ces recherches ont montré jusqu'ici qu'une attitude positive vis-à-vis de la préretraite favorise une adaptation satisfaisante quand l'heure de la retraite en est venue. Aussi, comme les problèmes concernant l'adaptation à une vie de retraité ne se présentent pas seulement quand l'employé abandonne le travail, il faudrait commencer à s'en préoccuper beaucoup plus tôt dans la vie. Une étude du type de celle-ci permet d'analyser les changements qui se produisent dans le comportement de l'individu au cours des années qui passent.

Une étude comparative sur les attitudes de 1,214 employés à l'âge de 54 ans et 48 ans indique qu'un plus grand nombre d'entre eux aspiraient à leur retraite à l'âge de 54 ans que six ans plus tôt. Des quatre facteurs choisis pour les fins de l'étude, lieu de résidence, niveau de revenu, milieu professionnel et degré de satisfaction dans la vie, qui étaient susceptible d'influer sur leurs attitudes à l'âge de 54 ans, seul le niveau de revenu s'est avéré significatif en ce qui a trait à la retraite. Moins de travailleurs songeaient à la retraite dans les groupes de niveau de revenus faibles que dans les groupes de niveau de revenus moyens ou élevés.

À mesure que le sujet vieillit, il voit venir le moment de la retraite avec moins de réticence et il se montre favorable à laisser le marché du travail à un âge moins avancé. À l'âge de 54 ans, il estime que la retraite devrait être moins tardive qu'à l'âge de 48 ans. À l'un ou à l'autre âges, alors que, dans la grande majorité des cas, les employeurs estiment que l'âge normal de la retraite devrait être à 65 ans ou au-delà, la majorité d'entre eux optent pour un âge inférieur. À 54 ans, si l'âge jugé normal pour la retraite s'élève, la proportion de ceux qui la souhaitent s'abaisse.

Les sujets considèrent davantage agréable à l'âge de 54 ans qu'à l'âge de 48 ans de pouvoir demeurer à la maison, de n'être pas astreint au train-train journalier du travail, de ne pas frayer avec des camarades de travail et de disposer de beaucoupde loisirs. À 54 ans, un plus grand nombre de sujets avaient apparemment trouvé des moyens de meubler les heures de loisir qui remplaceraient celles qu'ils passaient au travail. Les sujets qui, à l'âge de 54 ans, trouvaient agréable plutôt que désagréable de n'avoir pas à travailler aspiraient davantage à la retraite et à des heures de loisir plus nombreuses. Cependant, il n'en reste pas moins que, même s'il existe une tendance à vouloir être moins dépendants du travail, la majorité des sujets de 54 ans estimaient ennuyeux d'avoir à demeurer à la maison, de ne plus suivre leur train-train journalier, de n'avoir plus de contacts avec des camarades d'atelier ou de bureau.

Cette dernière perspective est susceptible de donner la voie à une nouvelle forme de « gérontologie industrielle ». Il se peut que, par le passé, l'on ait tellement insisté sur la valeur du travail et des relations qu'il contribue à créer que ceci nuise à une adaptation réussie aux autres âges de la vie, ce qui hypothèque lourdement le passage du travail à la retraite. Mais, comme le signalait le docteur R.N. Butler dans un article del’American Behavioral Scientist en septembre 1970 sur le vieillissement dans la société contemporaine, « loin de libérer l'homme de ses valeurs, de ses tâches et de ses engagements, la menace de très nombreux changements sociaux et technologiques l'attache davantage à eux sous plusieurs rapports et dans plusieurs milieux ». Les dirigeants des syndicats et de l'industrie, les sociologues et les responsables de la santé publique n'ont pas tort de craindre l'impact grandissant du « choc du futur ».

L'auteur tente de réaliser une mise en ordre des connaissances accumulées au cours de la dernière décennie dans le domaine du développement organisationnel. Après avoir établi une distinction entre approche globale et stratégies particulières, il procède à l'analyse de ces dernières pour en dégager la nature, les similitudes et les différences.

Organization development can be looked upon as a global strategy which tends to improve the problem-solving capacity of an organization and its ability to cope with changes in its environment. It is global in the sense that it takes the entire organization as a target of intervention. However, any organization development activity will rely on a particular strategy using a framework that draws heavily from the behavioral sciences. This paper intends to analyse and compare six particular approaches on four different grounds : the nature and the theoretical background of each strategy, the level of intervention and the goals each tries to achieve. The strategies will be reviewed and compared in the following order : action-research ; process consultation ; socio-technical systems ; transactional approach ; social-analysis ; non-directive orientation.

ACTION-RESEARCH

Is a term carried by Kurt Lewin in an effort to incorporate research work into action. The idea was to study group processes by participating in the life and the evolution of the group. Lewin realized that individual attitudes and behavior can be changed if the attitudes and norms of groups are changed. Action-research made explicit the main phases of any change process : diagnostic-feedback- commitment to action. This approach follows the stream of thought elaborated by the gestalt theorists and the hegelian concept of social evolution. It is particularly used at the group level. Since groups interact with other groups in large organizations, sooner or later, the structure and the inner working of an organization are put to question. Applied to an organization development activity, action-research will help to identify the forces that hamper or facilitate any change process.

PROCESS CONSULTATION

Is a particular strategy developed by Edgar Schein. It bears upon the organization processes : decision-making, communications, leadership, conflict resolution, etc... The change-agent and the client-system engage in a set of activities which helps the latter to have a better understanding of the processes at work in its own organization. The fundamental idea is « to help the client to help himself  ». The phases of the intervention are spelled out in a way that the beginning and the end of the change process may be visualized by the client-system. This approach makes use of the studies in social psychology dealing with leadership styles, communication openness, and conflict resolution methods. The organization development activity is conducted on an organization-wide scale while the effort bears on culture and processes. By helping the client to find better ways of solving problems, the strategy will in the long run tend to change the work climate of the entire organization.

THE TECHNO-STRUCTURAL APPROACH

Takes into account ail the major organizational and environmental variables that can explain the behavior of individuals and groups with the organization as well as the overall performance of the latter in its transaction with the environment. The major part of the organization development intervention consists of a thorough diagnostic of the strengths and weaknesses of an entire organization. The results of the diagnostic are fed back to the management at ail level in order to devise and implement a change program. The theoretical framework used in this planned effort comes from organization theories and related works which underline the impact of technology and environment on the performance of an organization. The intervention is conducted at many levels : organizational culture, structure, work groups and technology used. The objective sought is a better harmonization of the technology and the environment with the variables that characterizes the social system of a going concern.

THE TRANSACTIONAL APPROACH

This strategy is a refinement of the previous one. It has been developed by Lorsh and Lawrence. The diagnostic will begin with a study of the degree of certainty and stability in the environment, the market for the product or the service being the most important variable. Once the environment is known to the people in the organization, the structure is questioned to find whether it is ad equate or not to support the kind of transactions the organization entertains with its environment. The framework used in this planned effort has been elaborated by the authors in their book Organization and Environment. Lorsh and Lawrence would leave aside a cause-effect stream of thinking to resort to a circular process which yields a better picture of the interdependencies between segments of the organization and relevant parts of the environment. The intervention would be conducted at the level of the entire organization and its environment in order to achieve a better ad equation of the structures to the requirements of a changing or stable environment.

SOCIAL-ANALYSIS

This particular approach has been developed by Elliot Jaques in his Consulting work at the Glacier Metal Company. The main ingredient that differentiates this strategy from the previous ones is the type of helping relationship that evolves between the consultant and the organization in the course of the intervention. The consultant would take a non-interpretative attitude and would maintain an independent role vis-à-vis his client. In helping the client to have a better awareness of his problem, the consultant would provide a non-evaluative feedback so that the client discovers by himself what is meaningful to him. A better assessment of problems and their meaning will be conducive to more adequate solutions. The client is put into a position to learn by himself to cope with the problems he faces in assuming his management responsibilities. « In essence, social-analysis requires that an individual or individuals in an organization, with a problem concerning the working of the organization, should seek the help of an analyst in sorting out the nature of the problem. The analyst is independent in the sense that he is not embroiled in the organization and its problem ; he is from outside. He offers analytical help, rather than pushing for a particular course of action » (Elliot Jaques, « Social-analysis and the Glacier Project  », Human Relations, vol. 17, 1964, p. 364). Elliot Jaques conducted his main intervention at the Glacier Metal with a background and an experience in the field of psycho-analysis. This was an « unplanned  » effort which used the knowledge and methods of clinical psychology. The purpose was to improve the working of the organization while helping people to deal with the socio-affective dimension that enters in the analysis and solution of problems pertaining to the performance of a task.

THE NON-DIRECTIVE ORIENTATION

The non-directive orientation do not differ very much from the social-analysis. Again, this is an « unplanned  » effort to bring about change in organizations. It has been developed by Max Pagès and his colleagues. The intervention is centered on self-regulation phenomena within groups and organizations. In other words, communications among members of groups may be hampered by the various perceptions, attitudes and motivations of the members and by group norms. These phenomena must be assessed in order to increase openness and trust. The help the change-agent can provide consists of mirroring in a selective manner what is meaningful for the group or the organization. Max Pagès, in working with groups, uses a conceptual scheme drawn from the Lewin's theory of quasi-stationary equilibria. Max Pagès is also familiar with the Rogerian approach in the field of clinical psychology and education. This non-directive strategy tends to improve communications within groups and organizations, to help people to solve interpersonal conflicts, and to bring changes in the culture and the work climate of the organization.

It seems obvious that all effort of bringing change within organization seeks to increase its efficiency and health. The end-result is about the same ; however, some strategies seek to introduce new values in the dealing with human resources, other seek to increase the capacity for an organization to cope with changes in the environment. Differences appear among these particular strategies to the extent that a structured analytical framework is used at the beginning and in the course of each intervention. The action-research, the social-analysis, and the non-directive orientation will draw its conceptual scheme and learning material from the experience itself. Process-consultation, techno-structural and transactional strategies will tend to import learning instruments and material from the outside. Consequently, the degree of « directivity  » will differ according to the structuring of the intervention process. More research has to be done on the characteristics of the helping relationships and the evaluation of ongoing experiences in order to assess properly the similarities and differences among various strategies of organization development.

Le but de cet article est d'élaborer une solution aux problèmes soulevés par l'incapacité des organisations de prendre des bonnes décisions au moment où il le faut, et ce dans un environnement très complexe. Pour illustrer ce point, citons le cas de l'augmentation du taux de faillite de plus de 70% entre 1969 et 1970 parmi les entreprises dont le chiffre d'affaire dépasse le million. Suite à l'hypothèse qu'un tel problème résulte d'un développement inadéquat de l'individu ou de l'organisation, l'auteur examine les méthodes actuelles de développement surtout en ce qu'elles ont de commun, i.e. leur concentration sur l'individu. On reconnaît que l'individu est la pierre angulaire de toute organisation. Cependant son rendement à l'intérieur de l'équipe que forme l'organisation est plus importante que son rendement individuel.

Comme solution à ce problème, une méthode de formation en équipe analogue à celle utilisée par l'armée, la marine et l'aviation américaine est étudiée. Cette méthode peut former des individus compétents à l'esprit créateur à l'intérieur d'une organisation efficace et responsable qui ne faussera pas la croissance individuelle par sa bureaucratie.

En pratique, on peut mettre ce principe en application en utilisant, par exemple, une méthode de jeux et de simulation par ordinateur.

De nombreuses méthodes d'application et les systèmes diversifiés d'ordinateurs rendent facilement possible l'accès de ce principe à toutes les organisations.

Problems of the increasing rates of failure of modem business organizations are examined, with particular emphasis given to firms in the «million dollar plus» category. On the hypothesis that this problem has evolved from an increasing inability of organizational members to make immediate and accurate decisions, various individual and organizational development methods are examined. A common failing of all of these methods is their inability to train individuals in team behavior— the essence of the business environment. A method of «Team Training» is described that should serve to close the gap between development of competent individuals and the growth of the responsive and successful business organization.

Strikes are an integral part of the collective bargaining process and as such must be understood in relation to their determinants in order to properly evaluate the performance of that process. In spite of the importance of such knowledge there has been surprisingly little effort devoted to estimating empirical relationships.

Le présent article a pour objet d'analyser quelques-unes des études récentes consacrées aux répercussions des grèves sur l'activité économique. Le motif principal qui incite à l'examen de la relation entre les grèves et l'activité économique, c'est la mise au point de mesures législatives valables en matière de relations du travail. Une vague de grèves a pour effet de déclencher dans l'opinion publique un mouvement de pression qui réclame des mesures répressives, alors qu'une augmentation marquée du nombre de grèves peut être simplement le reflet des forces économiques en jeu et ne devrait pas, en conséquence, faire l'objet de mesures législatives nouvelles.

L'essentiel de l'article se trouve contenu dans les graphiques 2 à 5 exclusivement. Ces graphiques sont fondés sur une méthode d'analyse à laquelle des auteurs ont eu recours avec succès dans une étude sur le même sujet aux États-Unis. Les données utilisées pour les fins de ce travail sont trimestrielles et elles vont du premier trimestre de l'année 1953 au dernier trimestre de l'année 1968.

Le tableau 2 résume les principales conclusions et il démontre assez bien l'hypothèse que le taux de chômage a une influence marquée sur la fréquence des grèves au Canada, et, contrairement à la théorie marxiste, il ressort que les grèves sont plutôt des événements de caractère économique que de nature politique.

Un autre facteur important, ce sont les variations dans le taux de chômage. Pour un niveau donné de chômage, on peut s'attendre d'avoir davantage de grèves, lorsque le taux est à la hausse. C'est là, pourrait-on dire, un réflexe de défense de la part des travailleurs. On a aussi tenté de vérifier d'autres hypothèses comme la volonté des travailleurs, en période d'inflation, de défendre leur pouvoir d'achat. C'est également là un facteur positif. On a également fait entrer en ligne de compte les changements dans la composition de la main-d'oeuvre et le degré de syndicalisation. Ces deux éléments ne sont pas significatifs et ne donnent pas de résultats positifs.

Dans l'ensemble, on peut conclure qu'il y a similarité dans les causes déterminantes des grèves aux États-Unis et au Canada et qu'elles obéissent à un même rythme, contrairement à ce qu'ont pu affirmer certains auteurs. La grève est le plus souvent une réaction contre l'action des forces économiques défavorables aux travailleurs, et c'est de ce côté qu'il faut chercher d'abord les remèdes. The Quebec public sector industrial relations system could be easily depicted as a duplication of the private sector industrial relations system. The reason for this great similarity is the fact that the 1964-1965 revisions of the labour legislation made only slight distinctions between the two sectors. However, when we examine closely the various rounds of negotiations which occurred between 1964 and 1972, we discover substantial differences which can be attributed mostly to the particular nature of the government as an employer.

The purpose of this article is to analyse the Quebec public sector experience with collective bargaining (municipalities and universities are excluded from the scope of this study) from the period preceding immediately the adoption of the newLabour Code in September 1964 until the very last negotiations which ended on October 15, 1972 for most of the 250,000 public employees.

THE LEGAL FRAMEWORK BEFORE AND AFTER THE ADOPTION OF THE 1964 LABOUR CODE

Prior to the 1964 revision of the labour legislation, public employees in general had the right to bargain according to theLabour Relations Act of 1944, but disputes arising out of contract negotiations had to be submitted to compulsory binding arbitration pursuant to thePublic Services Employees Disputes Act and theAct Respecting Municipal and School Corporations and their Employees. Civil servants had no right to bargain since civil service regulations had unilateral control over their working conditions within the discretion of the National Assembly.

More precisely, as regards impasse procedures, there was a major distinction between the private and public sectors. In the private sector, the Labour Relations Act obliged the parties to submit their dispute to two compulsory procedures before obtaining the right to strike or lock-out. There was a conciliation period followed by a tri-partite arbitration panel whose recommendations were not binding. In the public sector, after the conciliation period, the arbitration panel's recommendations were binding upon the parties and public employees had no right to strike according to the Public Services Employees Disputes Act and the Act Respecting Municipal and School Corporations and their Employees.

The 1964 Labour Code represents quite a departure from the previous situation. First, there is no more separate legislation applying to public sector disputes. Civil servants were granted collective bargaining rights, including the right to strike. They are covered by a special statute — the Revised Civil Service Act of 1965 — but the « labour relations » section of that Act states that civil servants' labour relations are regulated by the Labour Code.

A uniform procedure, which is shorter than the previous one since the only requirement prior to exercising the right to strike is a conciliation period, applies to both private and public employees.

The only restriction applying to employees of a public service is that in addition to the general requirement of Section 46 they must give at least 8 days' prior written notice to the Minister of the time when they intend to have recourse to a strike. In the case of employees covered by theCivil Service Act, they are forbidden to strike unless the essential services and the manner of maintaining them are determined by prior agreement between the parties or by decision of the Labour Court. It is to be noted that, contrary to the Canadian Federal government where the determination is made on a permanent basis, in Quebec, this determination is made on an « ad hoc » basis each time a strike by civil servants is threatening.

Policemen and firemen are covered by theLabour Code but, contrary to other public employees, they do not have the right to strike. Their disputes are referred by the Minister of Labour to a council of arbitration upon the report of the conciliation officer. The recommendations of the council are binding and reasons must be given for the decision.

All other public employees have the right to strike if they have met the requirements of Section 46 and the 8-day notice period. However, a special procedure — a Taft-Hartley cooling-off period — allows the Lieutenant-Governor in Council to appoint a board of inquiry if the public health or safety is endangered by an actual or potential strike. Section 99 reads in part as follows :

Whenever in the opinion of the Lieutenant-Governor in Council a threatened or actual strike in a public service endangers the public health or safety, he may appoint a board of inquiry which shall have the powers of a council of arbitration to inquire into and report upon the dispute, save that it shall not pronounce any decision or make any recommendations, but must confine itself to ascertaining the facts in compliance with Sections 69 to 78 (procedural details).

Upon the petition of the Attorney-General after the appointment of a board of inquiry, a judge of the Superior Court, if he finds that the strike imperils the public health or safety, may grant such injunction as he deems appropriate to prevent or terminate such strike. An injunction granted under this Section must cease not later than 20 days after the delay of 60 days within which the board of inquiry must file its report, and such delay cannot be extended.

This Section shall apply to a threatened or actual strike which interferes with the education of a group of students as well as to a strike which imperils or endangers the public health or safety.

There is nothing in the law to deal with situations where the application of Section 99 fails to stop a strike. What generally happens in practice is a special legislative intervention by the National Assembly.

It should be noted that, at the time when theLabour Code was adopted, collective bargaining relationships were established on a completely decentralized basis and the government was staying out of the picture except in cases where it was the direct employer such as the civil service, technical and vocational education, and the Quebec Liquor Board. In the fields of education and hospitals, the government was only indirectly involved through subsidizing the cost of some arbitration awards which local school boards and hospitals could not finance.

THE THREE ROUNDS OF NEGOTIATIONS (1964-1972)The First Round (1964-1968)

The first round of negotiations starts with the period immediately following the adoption of theLabour Code. It is a period characterized by many social reforms which have been identified under the theme « Quebec's Quiet Revolution ».

Since most local unions were affiliated with one of the three central labour organizations, they could benefit from the services of a personnel with a great deal of expertise in negotiating labour-management contracts. As a result, the early part of that first round led to many union victories which could be attributed more specifically to the following factors :

1. The enormous gap between public employees' wages and salaries and those of private sector employees, which had the effect of justifying public sector unions' wage claims in the eyes of the public and, in turn, reinforce the unions' militancy.

2. A lack of coherent management policy which was due to many internal divisions between public employers and to a soft attitude by the government towards the unions. Many unions resorted effectively to « end run » lobbying i.e. obtaining, from a political intervention, favourable conditions which they were not able to get at the bargaining table.

3. The effective use of whipsawing tactics in the context of decentralized bargaining structures, mostly in hospitals and in education.

4. A great deal of the success can also be attributed to the precedents created during the illegal strikes of 1963 and 1964. Settlements reached on these occasions set the pattern for future claims by other unions which had not settled before the adoption of theLabour Code.

5. The impact of Expo-67 where key workers like Montréal construction workers, longshoremen and seafarers received fat settlements which set the precedents for identical wage claims by other employees, including public employees.

At the end of 1966, however, the unions faced a more rigid attitude from public employers which were now more directly influenced in their bargaining positions by the government. In education, school boards had to follow specific guidelines for wage increases if they wanted to benefit from the government's subsidies. Because of the teachers' résistance to the guidelines, the government had to resort to a special Bill (Bill 25) to stop a wave of strikes and to impose a uniform wage schedule in February 1967. In hospitals, the three week general strike of Summer 1966 was ended only after the government had placed the hospitals under trusteeship. Towards its own employees the government also adopted a strict position. Civil servants did not receive as high wage increases as they were expecting and, after some technical and vocational teachers had refused to call off a strike despite the issuance of an interim injunction under Sec. 99 of theLabour Code, 13 leaders were jailed for a twenty-day period.

The Second Round of Negotiations : (1968-1971)

Most collective agreements including the teachers' imposed settlement were to expire on June 30, 1968. Despite the previous provincial negotiations in hospitals and despite the fact that Bill 25 had the effect of centralizing bargaining in education, the bargaining structures in these two sectors were still officially decentralized : local hospitals and local school boards still had to ratify the contracts. On the other hand, the government's financial difficulties were far from being removed. As a result, the government had to use a delicate strategy not only towards the unions but also towards the official public employers involved. The practical instrument of that strategy was what has been called the « wage policy ».

Officially, the government wanted to increase the overall wage bill by 15% over a 3-year period. The strategy vis-à-vis the unions was to find a first group that would accept the offers and to apply the pattern to other groups, while the strategy vis-à-vis public employers was to let them fight with the unions until they needed technical and financial assistance from the government.

As regards the government's strategy towards the unions it was an almost complete success. Even if the principle of a 15% increase in the wage bill was notrespected in all instances, the government was still able to convince most unions to accept its offers without taking too many strikes. Moreover, the toughest résistance to the wage policy (that of Quebec Liquor Board employees who went on strike for more than 5 months) ended up in an almost complete submission by the union.

Contract negotiations in hospitals and in education provided a good example of the government's strategy towards the « official » public employers. As we have seen, the core of that strategy consisted of leaving the initial responsibility to the official institutions (theQuebec Federation of School Boards and theQuebec Hospitals Association) and in a second step to gradually provide technical and financial assistance. We think that the length of the negotiations in hospitals (18 months) and in education (almost 2 years) provides good support for this interpretation.

The major characteristics of the second round of negotiations may be summarized in the following points : First, the government won the principle of the wage policy and it was another step towards bringing more rationality into the government's expenditures. Secondly, as union solidarity among the various sectors was weak, the government was able to use a « divide and conquer » strategy. Thirdly, and as a consequence of the preceding point, there were few major clashes between the unions and the government as compared with the previous round of negotiations.

At the end of the second round, there is no doubt that the government has taken the initiative as regards the orientation of public sector labour relations. The unions' reaction will emerge in the next round.

The Third Round of Negotiations (1971-1972)

This round is essentially characterized by a centralization of the bargaining structure which permits the government to be directly involved in the bargaining process of the whole public sector and not only in the fields where it is the direct employer. This centralization process was achieved in two steps. First, a Civil Service Department was created on November 28, 1969. The Minister of the Civil Service was given authority to coordinate labour relations in the public sector at large including hospitals and education. Secondly, legislation was adopted at the end of June 1971 (Bill 46) which had the effect of reducing the number of bargaining tables to approximately 15 for the whole public sector.

It was the third time in as many rounds that the bargaining structure was modified !

The unions entered into these negotiations with the firm conviction not to let the government divide them as it did in the previous round : They wanted to present a « Common Front » to the employers. For this reason they formed a bargaining committee composed of representatives from the three central labour organizations and gave this committee authority to bargain over key issues such as wages, salaries and job security.

The government, for its part, submitted to this committee in March 1971 a document which contained the principles upon which its wage policy was based. Inthe Summer of 1971, the union delegation met the government delegation headed by the Civil Service Minister todiscuss these principles.

At the outset, there was considerable disagreement over the nature of these discussions and over the meaning and the implications of the principles contained in the wage policy. On the one hand, the unions were considering these preliminary meetings to be real bargaining sessions while the Minister was claiming that they were just preliminary discussions since negotiations were to occur at the 15 or so bargaining tables established by Bill 46. On the other hand, the Civil Service Minister stated that the government's wage policy was not negotiable while the unions wanted to negotiate the principles upon which that policy was based at one single centralized table.The parties left each other at the end of the last meeting with no agreement over what specific actions should be taken to permit genuine bargaining to begin.

Between September 1971 and January 1972, the government made known its offers to the various unions. During hat time, the unions made no counterproposals (at least not until February 29, 1972) and kept asking for the centralized bargaining table which they finally obtained on March 13, four days after 68.5% of the union members voted in favour of rejecting the government's offer and gave the mandate to their leaders to call a strike at anytime.

The union's strategy was quite simple : It consisted of waiting until the conciliation periods lapsed before making any counterproposals in order to obtain the right to strike as soon as possible and to put more pressure on the government so that it would grant the centralized bargaining table.

Accordingly, it is only as a result of this strategy — since the Civil Service Minister yielded the centralized bargaining table on March 13 — that serious bargaining could start.

The centralized bargaining table included almost the same delegation that had met during the summer of 1971 to « discuss » the principles of the wage policy, except that the Civil Service Minister wasnot present. It comprised almost 100 persons. Four issues were to be discussed : wages, job security, pension plan, and sick leave holidays or salary insurance as the government presented it. Practically, only the first two items were seriously discussed.

Even though serious bargaining was just starting, the Common Front called a general strike for March 22. The strike was postponed because of a severe snow storm ( ! ) and on March 24, the first « horse trades » were made. On March 28, public employees nevertheless went on strike. The government took out injunctions against the employees of some psychiatrie hospitals and of Hydro-Quebec. Despite the Common Front leaders' recommendations not to respect these injunctions, Hydro-Quebec employees returned to work and they dissociated themselves from the Common Front.

Negotiations broke down on April 6 and on April 11, another general strike went on that was to last until special legislation was adopted on April 21. The legislation (Bill 19) had the following effects :

— It ended the general strike.

— It convoked the civil service Parliamentary Commission.

— It stipulated that if no agreement between the parties was reached by June lst, the government would decide unilaterally the terms of the contract through a decree effective June 30th and valid until June 30th, 1974.

— It provided for fines for the breaking of the law of $50. to $250. per day, per worker and of $5,000. to $50,000. per day per union leader or the union itself.

The unions' reaction to Bill 19 was spectacular but short in duration. It consisted mainly of sporadic wildcat strikes throughout the Province between May 11 and May 15 which were mainly aimed at protesting against the jailing of the three Common Front leaders which had recommended to their affiliates not to respect the injunctions.

After the government had changed its negotiating team — the Minister of Labour now assuming responsibility over the Department of the Civil Service — bargaining resumed. From then on, the unions' strategy was to force the government to impose unilaterally a decree upon them. Since the government did not want to risk the political consequences of such action, it twice postponed the adoption of the decree until finally, after granting the unions some concessions such as a cost of living clause and a more generous salary insurance plan to mention only two, it was able to « convince » most unions to sign a collective agreement. However, for some 85,000 teachers and 2,500 Liquor Board employees, no settlement was arrived at and the decree had to be passed.

MAJOR ISSUES

By way of conclusion, three remarks are related to the major issues involved in these negotiations : the political nature of the conflict and the objectives sought by the parties ; the strategies respectively used ; the functionning of the industrial relations system in the public sector.

Political Nature of the Conflict

One of the basic prerequisites for the collective bargaining institution to work in the public sector is the establishment of an appropriate distinction between the State as legislator and the State as employer, distinction which leads to an effective delegation of powers to administrators who are dealing with the unions. The preceding requirements have been very tough to meet in reality in every political jurisdiction in North America whatever the nature of the legal framework in which labour relations were evolving. This is so because of the dual system of pressure tactics available to public employees — political and economic. As regards the Quebec experience, serious efforts were made with regards to respecting the requirements of the system. The first Civil Service Minister conceived and played his role in this fashion. He gave a clear mandate to his negotiators and refused to be personally involved in negotiations until the last moment when a final effort was made to settle the strike. This represented quite a different situation from the previous negotiations where « end run » lobbying was the general rule. However, the failure of the « professional » approach led to a new politization of the conflict as can be confirmed by the appointment of Mr. Cournoyer as Civil Service Minister.

« Politization » of this kind is not typical of the Quebec situation but can be found in most public sector bargaining in North America. However, as in manyother aspects of our political, economic and social lives, the Quebec experience does not contain the sole elements of « politization » mentioned above. We find also what can be called some elements of « over politization » of the conflict. By « over politization » we refer to the Common Front's objectives of « breaking up the system ».

It is our contention that by pursuing such objectives, the Common Front was fighting for a lost cause. First, the Common Front never explained to the populationbefore Bill 19, the political goals it was seeking through these negotiations. By doing this, it deprived itself of the support of potential allies during the battle. Further, the strike the Common Front was engaged in was hurting third parties who had nothing to do with the outcome of negotiations, thus reducing even more the possibility of getting support from an important portion of the population. Secondly, as can be seen from the events that followed passage of Bill 19, it became clear that even if the Common Front had tried to get support for its political objectives by explaining these objectives before or during the strike, it would not have got such support : Public opinion was overwhelmingly in favour of the sanctions taken by the government against union leaders ; opposition parties, including theParti Québécois, severely reprimanded the unions attitude of transgressing injunctions ; finally, even union members themselves disavowed the general movement of illegal strikes into which their leaders led them after the jailing of the Common Front leaders.

These remarks on the political objectives involved in these negotiations lead us to stress the tremendous cleavage that now exists within the Quebec labour movement between some leaders, union officers and a group of militant and the vast majority of the rank and file. In general, the rank and file is supposed to be less radical than the leadership but, we think that in Quebec, the gap between the two has reached a proportion larger than anywhere else in North America.

The Strategy Used by the Parties

The strategy used by the government was one of firmness. When the Civil Service Minister stated in the summer of 1971 that the government's wage policy was not negotiable, he adopted an attitude that was tantamount to the one taken by Premier Jean Lesage in 1962 when he affirmed that the « Queen does not bargain with her servants ». Such a statement, taken literally, challenges the whole theoretical foundations of the collective bargaining system in the public sector. It means that the first government offer is final and definitive.

Despite appearances, we think that such was not the case and that the Minister d/d not have in mind a return to a unilateral system of determining wages and working conditions when he made his declaration. But even then, the situation is quite equivocal : on the one hand, the Minister's declaration can be considered only as an element of a strategy to blur the unions' position and increase their « cost of disagreeing with the employer's terms ».

On the other hand, it is possible that the government believed it wage policy not to be bargainable but that it had accordingly prepared its first offer in such a fashion as to leave a margin between the initial offer and what was considered to be its maximum level of acceptability. This seems to be the most realistic probabilitysince the government has moved (a little) from its original position during negotiations. In the end, however, we think that it all comes down to a matter of relative bargaining power. The government knows what it can concede to the unions without having to raise taxes and/or modify other governmental priorities. If the unions are powerful enough to persuade the government that it would be wise policy to increase considerably public employees' wages and salaries, then politicians would have to take the political risk of raising taxes or reducing services. But it would take a very strong labour organization to achieve such an end, because a government has very little to lose by being firm with the unions unless they can constitute an electoral threat. This is not the case in Quebec given the cleavage mentioned above between the rank and file and the leadership, and given the absence of stable relationships between the labour movement and a special political party.

The strategy used by the unions was a reflection of both economical and political considerations. They entered into negotiations with the firm conviction they should prevent the government from dividing them as had happened in 1968. Thus, early in 1971, representatives of the three central labour organizations decided to present a Common Front to the government. The practical implications of that commitment were that individual unions should leave to the Common Front the task of bargaining over major issues such as wages and job security. Such a goal could be achieved only if a centralized bargaining table was granted. Hence the whole union strategy during the first three phases of negotiations was aimed at building up solidarity among the various local unions. Every local union's collective agreement project had either a blank spot or a general declaration as its wage clause. This attitude is quite in conformity with that used by any unions not necessarily committed to the goal of changing the whole political system.

On the other hand, the building up of union solidarity was also necessary for the realization of the Common Front's political objectives. A great show of strength was necessary for the advancement of the major cause (sic). The $100.00 a week minimum salary (which could find little objection in the population) was quite indicative of the desire to rally public employees behind their leaders and to initiate militant action. By keeping the debate within the confines of traditional economic objectives, the leadership could mobilize the rank and file for two targets at the same time. This is probably the reason why the Common Front leaders took so much time to reveal their real political intentions, although anyone acquainted with the evolution of the Quebec labour movement could foresee such an eventuality by following the leaders' public declarations in the last few years.

Impact on the Collective Bargaining Institution

Our last remark has to do with the implications of the recent events upon the collective bargaining institution itself. One of the main characteristics of the Province of Quebec industrial relations system in the public sector since the adoption of theLabour Code has been the regular transgressing of injunctions. Yet, when theLabour Code was passed and the right to strike granted to public sector unions, it was well accepted by all interested parties including the unions that article 99 (emergency injunctions) was the « quid pro quo » for that right to strike. Moreover, such a tendency to transgress the law has extended to many private sector conflicts. As a result, any analysis of labour relations in the Province of Quebec that would takefor granted that these labour relations are evolving within specific rules well accepted by the parties would miss a crucial point : each new conflict challenges the basic foundations of the industrial relations system.

The actual split within the CNTU provides a clear illustration of that new form of unionism : the French and Italian type of global contestation as opposed to traditional business unionism. As for the teachers, it seems as if they will engage in the former type of action.

Within such a context, we personally receive very coldly the recommendations of those who think that an Inquiry Commission should study Quebec's public sector labour relations and that profound transformations of the institutional framework should be made. First, with all the changes that occurred to bargaining structures (from decentralized (1965), to partially centralized (1966-68) to fully centralized bargaining (1971)thesystem was never given a real chance to work. In our opinion, the only changes that would have to be made do not require the usually wasted energy of an Inquiry Commission. They would have to deal with 1 ) a more rigorous definition of essential services (and the Federal civil service should be used as a good point of reference ; 2) a different time-table procedure for negotiations. It is absolutely untolerable that the unions' demands be made two monthsafter conciliation notices are sent to the Labour Minister. It should be mandatory that the demands and offers be known to the respective parties two months before the contract expires and that negotiations be terminated before the adoption of the provincial budget.

On the other hand, even if major institutional changes are to be made as a result of a so-called study commission's recommendations, it will nevertheless completely miss the basic problem. Whatever the legal framework's characteristics, it will not work if the parties that evolve within that framework do not take their responsibilities and do not respect the basic rules of the game. It is a problem of attitude and no study commission can cope with deficiencies of this nature. This is unfortunately the kind of situation presently existing in Quebec.

EN :

A collective agreement covers only part of the relationship between the employees covered by the agreement and the employer. Some conflicts of interest not covered by the agreement may be resolved voluntarily by negotiation from time to time, but there remain conflicts of interest in which either no resolution can be worked out on one party, the employer, supported by the residual rights doctrine and the agreement, refuses to negotiate. The issue has become a matter of great public controversy in Canada in recent years and was highlighted by the technological change debate.

La convention collective régit seulement une partie des relations entre les travailleurs couverts par cette convention et l'employeur. Certains conflits d'intérêt non sujets à la convention peuvent parfois se régler volontairement à l'intérieur des cadres de la négociation. Cependant il en est d'autres pour lesquels il n'y a pas de solution ou que l'une des deux parties refusera de négocier en se basant sur la doctrine des droits résiduels ou la convention elle-même. Ceci peut causer de la frustration chez les travailleurs et conduire à poser des actes illégaux. Ce problème a suscité récemment une importante controverse dans l'opinion publique et a été mis en évidence lors du débat sur les changements technologiques à la suite de l'introduction des locomotives diesels par les chemins de fer. Les syndicats ont insisté sur le droit de négocier ces questions pendant la durée de la convention ou pour limiter le droit de la direction d'apporter de tels changements pendant la durée de la convention si de tels changements ont un effet négatif sur l'emploi ou sur les conditions de travail. La direction a fortement refusé ces deux approches et a prôné le statu quo à ce sujet.

Diverses mesures ont été proposées pour régler ce problème. Certaines l'ont été à la suite de recherches effectuées par des groupes non engagés dans ces problèmes. Le projet de Code canadien du travail contient toute une partie longue etcompliquée qui reflète un changement de politique à cet égard au niveau fédéral. Le gouvernement de la Saskatchewan a aussi apporté des changements dans sa politique.

Le Code canadien du travail permet la négociation collective pendant la durée de la convention si le Conseil des relations de travail juge que le changement technologique proposé touche les conditions de travail ou la sécurité d'emploi d'un nombre important d'employés. En plus, si ces négociations n'aboutissent pas, on peut légalement recourir à la grève. L'employeur peut se protéger en donnant un avis de changement pendant la période normale de négociation avant que la convention ne soit signée. Ceci fournit au syndicat l'occasion de négocier les effets probables des changements annoncés.

L'Équipe spécialisée en relations du travail a proposé que les parties pouvaient inclure, à la signature de la convention, une clause de réouverture concernant les conversions industrielles. Dans un tel cas, la négociation et la grève seraient permises pendant la durée de la convention. Le juge Freedman a recommandé que si, suite à une demande syndicale un arbitre décide que les effets d'un changement proposé sont majeurs, l'employeur ne pourrait pas effectuer ces changements avant les nouvelles négociations. Sa recommandation ne comprend pas le recours à la grève comme le prévoit le projet de Code et comme le faisait le Rapport de l'Équipe spécialisée. M. Jean Marchand, ancien ministre de la main-d'oeuvre, suggère que si l'employeur décide d'introduire des changements influençant les droits des employés, la convention devrait automatiquement expirer et de nouvelles négociations devraient être faites. Le professeur Paul Weiler propose que l'obligation de négocier ne devrait pas se terminer avec la signature de la convention, mais devrait continuer d'exister pour tous les problèmes qui ne sont pas déjà couverts par l'accord.

Les recommandations de Weiler et Marchand détruiraient à toute fin pratique la doctrine des droits résiduels. Le Code du travail révisé protégerait cette doctrine pour des changements mineurs mais l'abrogerait dans des cas importants tels que définis par le Conseil des relations de travail. L'Équipe spécialisée, pour sa part, respecte la doctrine des droits résiduels mais autoriserait les parties à en négocier la portée dans les cas de conversion. La proposition Freedman transférerait, dans les changements majeurs, les droits résiduels au syndicat.

Une modification de la proposition de l'Équipe spécialisée inclue dans le Rapport de la Commission d'enquête sur l'industrie de la construction en Nouvelle-Ecosse (1970) propose qu'on maintienne les dispositions légales actuelles mais que les parties soient libres, pendant la période normale de négociation, de s'entendre pour enlever en partie ou totalement les contraintes imposées dans les négociations par la loi et d'y inclure le recours à la grève.

Cette dernière proposition est préférable, car elle laisse aux parties les décisions sur les matières négociables ainsi que les contraintes de la doctrine des droits résiduels. En plus elle évite l'intrusion de l'appareil bureaucratique comme le Conseil des relations de travail et les arbitres.

En fait, ceci est le résultat du critère de « nombre important ». Ce n'est ni bonne législation ni justice que de ne pas s'occuper des cas individuels sous prétexte du coût inévitable du progrès.

La définition de la grève

Le bill cherche à rendre synonyme au terme « grève » les expressions « ralentissement du travail » et « activité concertée ». Ceci est difficile à comprendre vu qu'un ralentissement du travail peut résulter d'une baisse du moral des travailleurs, ou être un indicateur valable d'un problème profond de relation patronale-ouvrière.La composition du Conseil canadien des relations du travail

Dans la loi actuelle, ce Conseil se compose d'un nombre égal de représentants des travailleurs et des employeurs. L'efficacité du Conseil dépend de sa représentativité. Le bill prévoit la désignation de personnes dites neutres. Il y a là danger que les nominations soient faites par favoritisme politique.

Les débats sur les avantages de la nouvelle loi dans les questions de changements technologiques peuvent donner l'impression qu'elle règle tous les problèmes. Il ne faut pas oublier qu'avec les réductions d'emploi que causent les conversions industrielles il est aussi important de noter la nécessité de nouvelles mesures visant le plein emploi, la nécessité de formation efficace de la main-d'oeuvre, de mobilité améliorée et de nouvelles opportunités pour la main-d'oeuvre féminine.

Dans les manuels courants d'économique et en théorie, on considère le loisir comme synonyme du temps où l'on n'est pas en disponibilité sur le marché ou du temps où l'on n'est pas à son poste ; le travail est, de son côté, synonyme du temps où l'on est disponible pour travailler ou du temps où l'on occupe son poste. En théorie économique, la distinction entre le temps libre et le temps engagé est importante, surtout quand il s'agit d'analyser l'offre de travail et, tout particulièrement, d'examiner une courbe d'offre de travail renversée.

Cet article vise un double but : d'abord essayer de définir la notion de travail et de loisir en termesopérationnels, c'est-à-dire en tant que phénomènes observables ; ensuite, chercher à réexaminer, à partir de définitions nouvelles du travail et du loisir, plusieurs problèmes qui se posent en économique et à tenter d'illustrer comment ces définitions nouvelles peuvent ouvrir des perspectives neuves à des questions anciennes et actuelles.

NOUVELLES PERSPECTIVES EN MATIÈRE DE LOISIRS

La première constatation à laquelle on arrive, quand on essaie de rebâtir une définition du loisir, c'est qu'il n'y a guère d'activité qui soit travail pur ou loisir pur. De là, ce qui importe, c'est de découvrir une définition qui permette la catégorisation d'une activité selon qu'elle est plus ou moins empreinte de loisir.

Au départ, nous affirmons qu'une activité est d'autant plus empreinte de loisir que la personne est moins gênée par la routine quotidienne et les contraintes de temps et d'espace.

La routine : Par routine, nous voulons dire qu'il n'y a que peu de façons d'entreprendre et d'exercer une activité. Plus une activité laisse de choix, plus elle se rapproche de la notion de loisir.

Le temps: Moins une activité est enfermée dans des limites de temps, plus on peut l'assimiler au loisir.

L'espace: Moins une activité oblige à demeurer sur place, plus elle s'apparente au loisir.

Plus une personne est en mesure d'exercer une activité sans se sentir contrainte par ses choix, dans ses mouvements dans le temps et dans l'espace, plus on considérera qu'elle dispose de loisir. Naturellement, il s'agit là d'une notion toute relative et le degré véritable de loisir pourra varier d'un individu à l'autre.

QUELQUES APPLICATIONS PRATIQUES DE CETTE DÉFINITION NOUVELLE

On peut considérer trois applications pratiques qui montrent la portée des problèmes qu'on peut analyser en regard de cette définition nouvelle.

a)Les taux différentiels de croissance du temps passé hors du travail. Si l'on estime la croissance du temps libre découlant d'une semaine de travail plus courte, de vacances plus longues, de jours fériés plus nombreux dans l'industrie manufacturière au Canada pour la période 1949-1969, on arrive à un résultat qui intrigue quelque peu. Au cours de cette période, les cols blancs ont bénéficié de 119 heures de plus de temps libre, tandis que les cols bleus en ont gagné 230. Cette constatation trouve une explication plausible si l'on se reporte à la nouvelle définition du loisir. On peut émettre l'hypothèse que, règle générale, dans l'industrie manufacturière, les cols blancs sont moins liés que les cols bleus à la routine ainsi qu'aux contraintes de temps et d'espace.

b) Un autre domaine où nous pouvons appliquer cette nouvelle forme d'appréciation, c'est lorsqu'il est question de la théorie dufonds des salaires, qui remonte au moins jusqu'à Adam Smith, où l'on s'est rendu compte que c'est le « gain net » parmi diverses occupations qui détermine la répartition du travail entre les différents métiers ou professions. À partir de là, outre les motifs déterminants du « gain net » d'ordre purement pécuniaire, on a aussi découvert l'existence de motifs déterminants « psychiques » qui n'ont rien à voir avec l'argent.

On peut donc soumettre ici que la part de loisir comprise dans un poste constitue une excellente source de motifs psychiques impondérables qu'on désigne souvent sous le nom de conditions favorables ou défavorables associées au travail. Plusieurs de ces conditions se retrouvent dans la routine et dans les contraintes de temps et d'espace. Même si le loisir, selon cette définition nouvelle, ne peut être encore estimé d'une façon précise, on peut le considérer comme un phénomène observable à qui on peut donner un rang ordinal dans une échelle graduée.

c) La dernière application de la nouvelle définition du loisir est reliée au vieux problème de l'exactitude des comptes nationaux en tant que reflet du degré de bien-être social d'une collectivité. Une des principales faiblesses du produit national brut dont chacun peut se rendre compte, c'est qu'il ne révèle pas le temps libre qui est certainement un avantage et qui, en réalité, compense pour un revenu plus élevé quand nous le présentons sous la forme d'une courbe d'offre du travail renversée. Il n'y a guère de doute alors, si le produit national brut doit être considéré comme une mesure du bien-être, qu'il faille la corriger de manière à tenir compte de l'accroissement du temps consacré au loisir.

Si l'on ne les observe que durant une période d'une durée restreinte, les avantages résultant du loisir associé au travail n'ont que peu d'importance et on pourrait à peine en percevoir le sens. Mais, considérés au cours d'une période plus longue, étant donné que des changements de structure significatifs se sont produits dansla composition de la main-d'oeuvre, il faudrait être très myope pour ne pas y déceler la possibilité des gains obtenus sous la forme du loisir associé au travail. Ainsi, au Canada, un des changements les plus frappants dans la structure de la main-d'oeuvre a été l'augmentation de l'emploi dans le secteur des services par rapport au secteur de la fabrication. Entre 1931 et 1969, l'emploi est tombé dans le secteur secondaire de 60 à un peu moins de 40 pour cent de l'emploi total, et le taux de changement ne semble pas être près de se ralentir. Quelles répercussions ces transformations ont-elles sur le bien-être ? En se fondant sur la nouvelle définition du loisir, on peut soutenir ici que cette croissance rapide de l'emploi dans le secteur des services s'est traduite par une augmentation du loisir associé au travail.

Même s'il se trouve des exceptions, je crois qu'il est exact de dire que les travailleurs du secteur tertiaire sont censés, dans l'ensemble, disposer de plus de loisirs au cours de leur travail que ceux du secteur secondaire.

Parce que ces emplois sont d'une nature plus intellectuelle, les travailleurs du secteur tertiaire peuvent au moins exécuter une part de leur besogne n'importe où et n'importe quand, et par conséquent, il devient de plus en plus difficile pour nombre d'employés de ce secteur de faire le partage entre le temps où ils sont à leur poste et celui où ils ne le sont pas.

Il apparaîtrait dès lors normal de reconnaître les avantages du loisir associé au travail, même s'il n'est pas possible de les apprécier numériquement, comme des gains obtenus sous la forme d'un mieux-être et comme un composant de toute nouvelle mesure de bien-être du produit national brut.

CONCLUSION

Autrefois, lorsque le travail pour une large part consistait en une activité physique où l'esprit n'occupait que peu de place, peut-être que le travail et la présence au poste d'une part, et le loisir et l'absence du poste, d'autre part, pouvaient-ils être presque synonymes. Aujourd'hui, à la suite du développement rapide du secteur tertiaire, il faut nous rendre à l'évidence qu'on peut trouver le loisir au poste même.

Il ne faut pas en conclure, cependant, que la dichotomie présence au travail et absence du travail n'existe plus. Tel n'est pas le cas. Tout ce qui est soumis ici, c'est que les manuels d'économie politique traditionnels ne devraient plus affirmer que le temps de présence au travail est formé exclusivement de travail et, à partir de là, essayer de montrer qu'il y a entrecroisement entre loisir et travail quand, en réalité dans leurs exposés sur la courbe d'offre de travail individuel ils tiennent à la fois compte du temps passé au travail et du temps passé hors du travail.

La prise de décision en matière de règlement des griefs suscite toute une série d'interactions entre le syndicat et la direction. Le présent article est fondé sur une étude qui s'est faite dans cinq entreprises de sidérurgie aux États-Unis au cours des années 1967 et 1968. Le travail a consisté dans l'analyse des dossiers, dans des entrevues et des observations diverses. Évidemment, les constatations ne portent que sur une seule industrie, celle de l'acier mais, à quelques nuances près, elles sont susceptibles de valoir d'une façon générale, du moins dans l'industrie manufacturière.

Les cas, qui ont été analysés, peuvent se diviser en cinq groupes distincts : la violation de la convention collective par l'employeur, le désaccord sur des faits, l'interprétation de la convention collective, la façon dont la convention est appliquée, les divergences d'opinion au sujet des méthodes d'action.

D'une part, on s'est intéressé d'abord au comportement du syndicat qui peut différer selon sa conception de l'action syndicale, selon son état en tant qu'institution de nature politique. Certains syndiqués s'attaquent automatiquement aux décisions patronales et présentent des griefs formels à chaque fois que l'occasion s'en présente. D'autres syndicats s'attaquent principalement aux nouvelles classifications d'emploi et les griefs de ce genre se règlent généralement en présence du représentant international ou sont soumis à l'arbitrage. D'autres, par exemple, combattent vigoureusement la sous-traitance. Enfin, des griefs formels sont soumis et portés à l'arbitrage chaque fois qu'un salarié ou un groupe de salariés a quelque raison d'espérer de l'arbitrage un avantage matériel quelconque.

La situation politique au sein du syndicat exerce aussi une influence certaine sur la façon de traiter les griefs. Le nombre des griefs a tendance à augmenter lorsqu'il y a lutte entre différents clans à l'intérieur du syndicat et l'attitude à l'endroit des réclamations revêt alors une saveur électorale. On observe aussi un phénomène identique lorsque des groupes de pression se forment pour combattre une décision patronale dans un département.

Toutefois, du côté syndical, le principal facteur qui influe su? le traitement des griefs est sans conteste l'attitude des dirigeants. On peut, à ce propos, classer les dirigeants syndicaux en cinq catégories : il y a les inactifs, les chefs soucieux de régler les problèmes, les avocats et, finalement, les radicaux et les politiciens.

Selon ces différents types de dirigeants syndicaux, on procédera différemment dans le traitement des griefs. L'inactif ne bouge pas : le véritable négociateur a tendance à éviter la présentation de griefs écrits et à discute? au mérite chaque cas soumis ; l'avocat est enclin à défendre la cause jusqu'au bout, qu'elle soit bonne ou non ; quant aux politiciens, ils amassent du capital et, avec les radicaux, ils contestent systématiquement les décisions patronales.

La nature du travail, l'organisation de l'entreprise et le milieu ambiant jouent aussi un rôle sur le nombre des griefs et la façon de les traiter. Ainsi, dans une localité dont la population est peu nombreuse sera-t-on plus enclin à discuter les griefs d'une façon informelle. Enfin, il faut noter que la façon dont procède la direction dans la prise de décision et l'organisation même du service de relations du travail comptent pour beaucoup dans la façon dont les syndicats agissent en matière de traitement des réclamations. Il arrive que le service des relations du travail ne bouge pas tant qu'il n'est pas en présence d'un grief présenté par écrit en bonne et due forme.

Du côté patronal, l'attitude des dirigeants peut se comparer dans une certaine mesure à celle des chefs syndicaux. L'enquête a permis de déceler qu'il y a des employeurs inactifs qui cherchent à éluder les problèmes ou se contentent de référer les cas soumis au service des relations du travail, les dirigeants soucieux de régler les problèmes d'une façon informelle tout comme leurs collègues syndicaux et, enfin, les employeurs autocratiques, qui, au nom du principe de l'autorité, ont pour politique de défendre jusqu'au bout ce qu'ils considèrent être de leurs prérogatives qu'elles soient justes ou non, et qui sont fermés à toute forme; de compromis. Ces attitudes de base se reflètent naturellement dans la façon de traiter les griefs aux différentes étapes de la procédure.

Dans l'ensemble, on peut dire que, en règle générale, l'attitude des employeurs dépend beaucoup de celle des chefs syndicaux, et il y a là une interaction certaine. Il faut aussi noter que, aux étapes préliminaires de la discussion, les employeurs sont sensibles à ce que serait la décision d'un arbitre ou d'un tribunal d'arbitrage. Ils tiennent généralement compte du coût financier du litige et aussi des avantages que peuvent apporter à longue échéance des compromis acceptables.

En bref, le syndicat, devant un grief, doit décider s'il doit le défendre et comment il lui faut le défendre : d'autre part, sujet aux stipulations du contrai:, l'employeur se place dans une situation à peu près identique de défense.
