Résumé
Cet article examine dans quelle mesure la notion de reconnaissance peut renouveler ou enrichir la réflexion normative sur la justice. La discussion des thèses de Nancy Fraser sur la question conduit à distinguer deux usages de la notion de reconnaissance. Le premier se réfère à l’analyse des causes culturelles de certaines injustices. Le second sens, proprement normatif, identifie un type d’exigence de justice susceptible de fonder l’évaluation de situations et d’orienter l’action publique. Si elle peut se fonder sur l’idée de participation paritaire à la vie sociale introduite par Nancy Fraser, on ne peut toutefois, contre ce que cette dernière prétend, en dégager les implications sans une réflexion sur les présuppositions identitaires et psychologiques de celle-ci.
Abstract
This article looks at whether the notion of recognition can renew or enrich the normative reflection on justice. The close examination of Nancy Fraser’s theses on this topic leads to distinguish two meanings of this notion. The first one refers to the analysis of the cultural causes of certain injustices. The second one is normative : it identifies a type of requirement of justice on which can be based the evaluation of situations and of public action. In agreement with Fraser, this normative sense could rely on the idea of equal participation in the social life. But, unlike her claims, its implications should be laid on psychological and identity-related assumptions.

On mentionnera deux autres thèses explicitement formulées par Nancy Fraser (« Social Justice in the Age of Identity Politics », p. 47 ss) : a) La question de savoir si une revendication de reconnaissance peut être considérée comme exprimant une demande de justice légitime au regard du principe de « participation paritaire » ne peut être tranchée que dialogiquement, par la délibération démocratique. Celle-ci n’est toutefois possible que si les conditions minimales d’une participation paritaire sont satisfaites. Il y a donc circularité (non « vicieuse » mais « réflexive »). Nous reviendrons brièvement sur cette thèse à la dernière section de cet article. b) La question de savoir si la reconnaissance (ou la redistribution) appelle des politiques de traitement identique ou de traitement différencié ne peut être résolue que pragmatiquement, en fonction du type d’obstacle à la participation paritaire qu’il s’agit de surmonter.
