Résumé
Depuis le premier tiers du xxe siècle, il est généralement admis que la responsabilité délictuelle et la responsabilité contractuelle se distinguent par leur régime et non par leur nature. La responsabilité contractuelle est passée d’un rôle d’exécution de l’obligation à celui de la réparation d’un préjudice causé à l’occasion de l’inexécution. Cette transformation s’est essentiellement faite par le gonflement du contrat, la responsabilité contractuelle étant jugée plus protectrice des droits de la victime. Partant du constat inverse, les auteurs entendent proposer, d’une double manière, que le régime de la responsabilité extracontractuelle soit le seul applicable, à tout le moins en matière de préjudice corporel
Delegeferenda, rejoignant une partie de la doctrine française, les auteurs suggèrent d’expurger du droit québécois la notion même de responsabilité contractuelle. De lege lata, ils appellent ensuite la jurisprudence à soumettre la réparation du préjudice corporel au seul régime extracontractuel de responsabilité. Une telle solution s’inscrit en continuité avec la jurisprudence et en phase avec la place particulière que le législateur québécois donne à la réparation du préjudice corporel.
Abstract
Since the first third of the 20th century, it has been generally recognized that delictual liability and contractual liability set themselves apart owing to their respective legal regimes and not by their very nature. Contractual liability has evolved from securing the performance of an obligation to redressing the harm caused by its non-fulfillment. This transformation has essentially resulted from an enlargement of the contractual sphere, owing to the fact that contractual liability was perceived to be more protective of victims’ rights. Since it has now become apparent that the opposite is true, the authors suggest a two pronged approach, with a view to reinstating extracontractual liability as the only applicable regime, at least with respect to bodily injury.
Rallying a part of French doctrine, the authors suggest that the ideal solution would be to purge the concept of contractual liability from Québec law. Yet looking at the law as it new stands, they call upon the courts to submit cases of bodily injury to the law of extracontractual liability only. This solution finds its place in the continuity of case law and is consistent with the specific place that the Québec legislator has assigned to the redressing of bodily injury.
