Résumé
La vocation d'un droit national du travail est primordialement territoriale. Dans le texte qui suit, l'auteur traite des institutions et des normes ayant cours au Québec. Devant l'accentuation de la mondialisation des rapports, en particulier économiques, dans quelle mesure pourra-t-on faire appel à ce droit, malgré son caractère foncièrement territorial, pour régir des rapports du travail comportant un ou des éléments d'extranéité ? Par ailleurs, ce même contexte favorise l'émergence de rapports du travail eux-mêmes de portée transnationale. Les droits nationaux du travail ne peuvent que les appréhender partiellement et diversement. De tels rapports appellent, sinon au dépassement juridique de ces droits nationaux du travail, du moins à leur coordination.
Abstract
National labour law is legislation that is primarily territorial in scope. In the ensuing text, the author expounds on institutions and legal rules found in Québec. Faced with the growing emphasis on globalized exchanges —especially economic ones —to what extent will it be possible to resort to this type of legislation, considering its inherent territorial nature, to oversee labour relationships with one or more foreign components ? Likewise, in this new context of world marketplaces, the emergence of transnational extended labour relations is increasingly favoured. Nation-based labour laws can only partially or incompletely encompass them. These relationships underscore how legal considerations must, at the most, extend beyond such national labour laws and, at the least, seek to coordinate them.
