Résumé
Une déclaration extrajudiciaire, étant un témoignage indirect, constitue la meilleure preuve susceptible de condamner un suspect. Les forces policières ont donc tendance à privilégier ce mode de recherche de la vérité au point de heurter certains des droits les plus fondamentaux des citoyens.
Les tribunaux, depuis plus d'un siècle, ont donc voulu pallier de telles situations en adoptant des règles de preuve et de procédure entourant la recevabilité des déclarations extrajudiciaires. Récemment, le Législateur a élevé au rang de garantie constitutionnelle certains de ces droits fondamentaux afin de protéger davantage les citoyens contre de telles violations.
Le texte qui suit vise à faire le point sur les règles procédurales entourant la recevabilité des déclarations extrajudiciaires, suite à la fusion des règles de common law et de celles de la Charte canadienne des droits et libertés.
Abstract
An indirect testimony, a confession constitutes evidence most likely to convict a suspect. It is not surprising, then, that police forces tend to favour this method of seeking truth, to the point of infringing upon some of the most fundamental rights of citizens.
For more than a century, therefore, the courts have sought to remedy such situations by adopting various rules of proof and procedure relative to the admissibility of confessions. In order to further protect citizens against this type of infringement recent legislation has raised some of these fundamental rights to the level of constitutional guarantee.
The purpose of the following text is to study the rules of procedure regarding the admissibility of confessions in light of the fusion of the rules of common law and those of the Canadian Charter of Rights and Freedoms.
