Pendant longtemps, le droit comparé s’est principalement intéressé à trois grandes familles ou traditions issues d’Europe, celles de droit civil, de common law ou des pays socialistes, même si ces regroupements dissimulaient d’innombrables divergences. Or, un droit d’origine romaniste (codifié ou non) peut survivre dans un État où prédomine la common law ; celui-ci est alors appelé un « pays de droit mixte ». Il en va ainsi des systèmes québécois et canadien, en raison de la dualité de leurs sources. Si la doctrine déplore traditionnellement le métissage du droit civil, elle admet aujourd’hui que, en dépit des emprunts aux institutions et des références aux décisions de common law, le droit privé québécois demeure fondamentalement civiliste. Il a préséance en cas de lacune dans une loi fédérale, sauf si le droit public entre en jeu. Les textes du présent numéro de la Revue de droit McGill abordent divers aspects des systèmes juridiques mixtes d’autres territoires, soit Hong Kong, Macao, l’Afrique du Sud et Israël. L’indépendance judiciaire à Hong Kong semble menacée par la culture juridique autoritaire de la République populaire de Chine, malgré l’absence de toute modification institutionnelle apparente. En Israël et en Afrique du Sud, les juristes acceptent bien la coexistence de traditions différentes — germanique, britannique, américaine, coutumière. Cette ouverture d’esprit devrait se poursuivre à l’avenir, au moins pour les questions nouvelles ou controversées.

For many years, comparative law has focussed on three fundamental, European-based legal traditions: civil law, common law or socialist law. Yet this taxonomy masks important divergence within each tradition. Civil law (whether codified or not) can survive within a country where common law predominates, resulting in what is called a “mixed jurisdiction”. This is the case in the Quebec and Canadian legal systems, due to the dual origins of their sources of law. Given that legal doctrine is traditionally reluctant to infuse the civil law with other legal sources, despite references to common law institutions and judicial decisions, private law in Quebec remains fundamentally civilian. Civil law takes precedence in the event of a gap in a federal statute, except with regard to issues of public law. The articles of the present issue of the McGill Law Journal examine different aspects of the mixed legal systems of other countries, namely Hong Kong, Macau, South Africa, and Israel. Judicial independence in Hong Kong seems to be threatened by the authoritarian legal culture of the People’s Republic of China, without any apparent institutional changes. In Israel and South Africa, jurists accept the coexistence of different legal traditions—German, British, American, and customary law. This open-mindedness should be maintained in the future, at least to respond new or controversial issues.

The article aims to compare the case of the two Chinese Special Administrative Regions (SARs) of Hong Kong and Macau against the theoretical grid developed by Vernon V. Palmer to describe the “classical” civil law-common law mixed jurisdictions. The results of the research include an acknowledgement of the progressive hybridization of the legal systems of Hong Kong and Macau, hailing from the English common law and the Portuguese civil law tradition, respectively, by infiltration of legal models and ideologies from Mainland China.

The research also leads to a critical revision and refinement of the methodology and tools developed by Palmer in order to make them applicable to a wider range of processes of legal hybridization beyond “classical” mixes, and to a better appreciation of how transitional political and institutional phases play a critical role inlegal “mixity” or hybridity.

Cet article a pour but de comparer les cas des deux régions administratives spéciales (RAS) de Hong Kong et de Macao avec la grille théorique développée par Vernon V. Palmer afin de décrire les juridictions mixtes « classiques » droit civil-common law. Les résultats incluent une reconnaissance de l’hybridation progressive des systèmes juridiques de Hong Kong et de Macao, originaires de la common law anglaise et de la tradition civiliste portugaise respectivement, par l’infiltration des modèles juridiques et des idéologies de la Chine continentale.

La recherche amène également une révision critique et un affinement de la méthodologie et des outils développés par Palmer afin de les rendre applicable à un plus large éventail d’hybridation allant au-delà des mélanges « classiques » et à une meilleure appréciation de comment les phases de transition politiques et institutionnelles jouent un rôle critique dans la « mixité » ou l’hybridité.

South Africa’s transformation to constitutionalism in 1994 saw the addition to a mixed legal system of a supreme constitution that requires all law to conform to its provisions, principles, and values. This new constitutional design was developed for the circumstances and modeled on existing liberal democratic constitutions, the most influential of which were Canadian and German.

Adopted in 1993, the first constitution introduced the notion of the “constitutional state” but being only a transitional document, it provided for the creation of a “final” constitution crafted in conformity with prescribed principles. The final constitution, adopted in 1996, made no mention of the “constitutional state”, including instead the expression “rule of law”. Since the constitutional principles laid down in 1993 referred to neither the German “Rechtsstaat”, nor Diceyan “rule of law”, the replacement of the former term by the latter was permissible.

The two constitutional texts did not, however, elaborate on these two terms. It was left to constitutional interpreters, especially the judiciary, to give meaning to these historically disconnected but conceptually related ideas. The result was a completely novel and pervasive constitutional doctrine. The judicial process of merging these notions may be described as “comparison by global assimilation”.

La transformation de l’Afrique du Sud vers le constitutionnalisme en 1994 a vu s’ajouter, à un système juridique mixte, une constitution suprême exigeant la conformité de toutes lois à ses dispositions, principes et valeurs. Cette nouvelle organisation constitutionnelle a été conçue en fonction du contexte et inspirée des constitutions démocratiques libérales existantes, les plus influentes étant celles du Canada et de l’Allemagne.

Adoptée en 1993, la première constitution introduit la notion d’« État constitutionnel », mais elle n’était qu’un document de transition, qui prévoyait la création d’une constitution finale, rédigée en conformité avec les principes prescrits. La constitution finale, adoptée en 1996, ne faisait aucune mention de l’« État constitutionnel », incluant plutôt l’expression « primauté du droit ». Puisque les principes constitutionnels établis en 1993 ne font référence ni au « Rechtsstaat » allemand ni à la « primauté du droit » de Dicey, le remplacement du premier terme par le second était acceptable.

Les deux textes constitutionnels n’ont cependant pas précisé le sens de ces deux termes. Les interprètes de la constitution, particulièrement le judiciaire, durent donner un sens à ces idées conceptuellement liées, mais historiquement éloignées. Le résultat fut une doctrine constitutionnelle complètement nouvelle et omniprésente. Le processus judiciaire fusionnant ces concepts peut être décrit comme une « comparaison par assimilation globale ».

South Africa has a mixed legal system comprised of transplanted European laws (the core being Roman-Dutch law, subsequently influenced by English common law) and indigenous laws, referred to as customary law. This mix is also evident in South Africa’s marriage laws, which can roughly be divided into two categories: civil marriages or unions, and African customary marriages. Since 1994, the developments in these two categories of marriage have been revolutionary. The case law reads like a jurisprudential chronicle of factual situations never contemplated by the legislator, and the judiciary must resort to innovation to solve the intricacies of a constitutionalized mixed legal system. To deal with the challenges posed by the interaction of two seemingly equal legal systems in one legal sphere, the courts have followed a variety of approaches including legal positivism, the application of common law principles, and, more recently, the notion of transformative constitutionalism. The primary aim of this essay is to discuss the sometimes innovative and at other times confusing approaches followed by the judiciary in dealing with the complexities created by a mixed legal system, especially with regard to marriages between Africans.

L’Afrique du Sud a un système de droit mixte, comprenant un héritage de lois européennes (venant essentiellement du droit romano-néerlandais, influencé ensuite par la common law anglaise) et des lois autochtones, ou droit coutumier. Ce mélange est évident lorsqu’on regarde les lois sud-africaines du mariage, qui peuvent être divisées en deux catégories : mariages ou unions civiles, et mariage coutumier africain. Depuis 1994, les développements de ces deux catégories de mariage ont été révolutionnaires. La jurisprudence se lit comme une chronique de situations factuelles jamais envisagées par le législateur, et le judiciaire doit faire preuve d’innovation pour résoudre les complications résultant d’un régime constitutionnel de droit mixte. Pour répondre aux défis posés par l’interaction, dans une seule sphère juridique, de deux systèmes de droit en apparence égaux, les tribunaux ont suivi plusieurs approches, incluant le positivisme juridique, l’application de principes de common law et, plus récemment, la notion de constitutionnalisme transformateur. Le principal objectif de cet article est de discuter des approches parfois innovantes ou encore déroutantes que suivent les tribunaux afin de régler les complications créées par un système de droit mixte, particulièrement dans le domaine du mariage entre Africains.

Like in most Western countries, the legal system in Israel is constantly evolving. Israel is a mixed jurisdiction in many respects. Historically, during the time of the Ottoman Empire, the land of Israel was ruled by Turkish law, which was followed by British law during the time of the British Mandate. Today, Israel’s legal system still reflects a mixture of civil law and common law. This mixture is evident, for example, in the combination of codified law and precedent-based law. Several areas of the law were codified, at the time of the British Mandate, in ordinances that remain binding today. However, these ordinances were supplemented and widely interpreted in Israel’s case law, and an “Israeli common law” was created. Today, legislative efforts are being made to codify this new common law.

The mixed nature of substantive law in Israel is also illustrated by Israel's constitutional regime. While Israel has no formal constitution, it has a partial bill of rights (the basic laws) enacted by its parliament. In 1995, the Israeli Supreme Court decided, referring to American constitutional law, that it had the authority to invalidate “unconstitutional laws”. In its decision, the Supreme Court relied on a limitation clause, included in the new basic laws and inspired by the Canadian Charter of Rights and Freedoms. Since then, the Israeli Supreme Court has developed a number of constitutional rights from these basic laws, influenced by both the American concept of liberty and the European concept of human dignity.

Finally, comparative law plays an important role in Israeli case law. While British common law no longer binds the Israeli judiciary, judges have wide discretion to use comparative law in their decisions. When relevant, referring to foreign law may be of great assistance to a judge by providing inspiration in a difficult case. Utilizing many different sources of law may help to create harmony between various jurisdictions, especially in times of increasing globalization.

À l’image de la plupart des pays occidentaux, le droit israélien est en constante évolution. Israël est de juridiction mixte sous plusieurs aspects. Historiquement, à l’époque de l’empire Ottoman, les terres israéliennes étaient gouvernées par le droit turc. Celui-ci a été suivi par le droit britannique durant la période du mandat britannique. Aujourd’hui, le droit israélien reflète encore un mélange de droit civil et de common law. Ce mélange est évident, par exemple, dans la combinaison des lois codifiées et des lois basées sur les précédents. Plusieurs secteurs législatifs ont été codifiés, lors du mandat britannique, dans des ordonnances qui demeurent effectives de nos jours. Cependant, ces ordonnances ont été supplées et largement interprétées par la jurisprudence israélienne, ce qui a créé une « common law israélienne ». Aujourd’hui, des efforts sont faits afin de codifier cette nouvelle common law.

Une autre illustration du droit matériel mixte en Israël est son régime constitutionnel. Israël n’a pas de constitution formelle, mais a une déclaration des droits partielle (les lois fondamentales) adoptée par son parlement. En 1995, la Cour suprême israélienne a déclaré, en référence au droit constitutionnel américain, avoir l’autorité d’invalider toute « loi inconstitutionnelle ». Dans sa décision, la Cour suprême s’est basée sur une clause de limitation incluse dans les nouvelles lois fondamentales et inspirée par la Charte canadienne des droits et libertés. Depuis, la Cour suprême israélienne a développé un certain nombre de droits constitutionnels à partir de ces lois fondamentales, influencés à la fois par le concept américain de liberté et le concept européen de dignité humaine.

Finalement, le droit comparatif joue un rôle important dans la jurisprudence israélienne. Même si la common law britannique ne lie plus les cours israéliennes, les juges ont une large discrétion pour utiliser le droit comparatif dans leurs décisions. Lorsque pertinente, la référence au droit étranger peut être d’une grande assistance pour un juge, lui fournissant l’inspiration nécessaire dans un cas difficile. L’utilisation de plusieurs sources différentes peut créer une harmonie entre les différentes juridictions, particulièrement dans une époque de mondialisation grandissante.

This article examines the changes in the approach to the analysis of free speech rights in Israel. It demonstrates the growing shift from the American liberty-based influence in the 1980s to a more dignity-based, and principally Canadian- and German-inspired, model following the adoption of the partial bill of rights in the 1990s. This is demonstrated both by a statistical analysis of the Israeli Supreme Court free speech rulings in the past thirty years and by a substantive analysis of recent rulings in the areas of prior restraint, pornography, and libel.

The statistical findings demonstrate that while human dignity rarely played a role in free speech rulings in the past, it plays a significant role today. Another indication of the “dignitization process” lies in the reference to foreign rulings. Moreover, a substantive examination of the Israeli Supreme Court’s free speech rulings from the last decade reveals the dignitization process both in rhetoric and outcomes.

This article offers a means of strengthening the protection that free speech receives in Israel by divorcing the constitutional protection of free speech from the concept of human dignity, and by focusing on the value of liberty. This can be achieved by the incorporation of the unenumerated right to free speech via the liberty clause within Basic Law: Human Dignity and Liberty.

Cet article examine les changements dans l’analyse du droit à la liberté d’expression en Israël. Il démontre qu’un changement d’influence est en train de s’opérer, en passant d’une approche américaine basée sur la liberté vers une approche canadienne et allemande basée sur la dignité, suite à l’adoption partielle de la déclaration des droits dans les années 1990. Ceci est démontré par une analyse statistique des décisions des trente dernières années de la Cour suprême d’Israël, ainsi que par une analyse substantive des décisions récentes dans les domaines de la restriction préalable, de la pornographie et de la diffamation.

Les résultats statistiques démontrent que si la dignité ne jouait auparavant qu’un rôle très limité dans les décisions, le concept joue un rôle important aujourd’hui. Le fait de référer à des décisions étrangères est également un indice de ce « processus de dignification ». De plus, une analyse substantive des décisions de la Cour suprême d’Israël de la dernière décennie en matière de liberté d’expression permet d’illustrer ce processus de dignification, tant dans la rhétorique que dans les résultats.

Cet article offre un moyen de renforcer la protection de la liberté d’expression en Israël, en séparant la protection constitutionnelle de la liberté d’expression de celle de la dignité humaine, et en se concentrant sur la valeur de la liberté. Ceci peut être réalisé en incorporant le droit non-écrit à la liberté d’expression par le biais de la disposition sur la liberté de la Loi fondamentale : Dignité et liberté humaines.

La théorie de l’abus de droit est une théorie de la législation. Elle a pour objectif d’encadrer l’application des droits prescrits par les lois. Le titulaire d’un droit engage sa responsabilité lorsque l’acte qu’il autorise ordinairement est animé par l’intention de nuire. C’est là la formule du Code civil du Québec qui, en 1994, en a consacré le principe. Le principe de responsabilité que pose l’abus demeure toutefois problématique en ce sens qu’il vise des activités que la loi permet a priori. La théorie de l’abus donne en effet aux tribunaux le moyen de lever cette immunité de sorte que l’acte pourtant conforme à la lettre de la loi devient contraire à son esprit, c’est-à-dire au droit. C’est en ce sens que l’on peut dire que l’abus est l’anténorme. Ce principe de superlégalité donne une place de premier plan au pouvoir judiciaire : « par la jurisprudence, mais au-delà de la jurisprudence », écrivait Josserand. Il ne s’agit pas de donner aux tribunaux le droit de légiférer, mais plutôt d’éviter, dans des cas exceptionnels, la tyrannie des droits. L’étude de la théorie de l’abus de droit nous invite à redécouvrir les premiers mouvements de la pensée socialisante du début du vingtième siècle. Est abusif l’usage asocial d’un droit individuel. L’abus doit être ainsi replacé dans le contexte d’une doctrine civiliste fleurissante qui s’inscrit contre la méthode de l’exégèse et le subjectivisme juridique. Mais l’intérêt de son étude n’est pas simplement historique. Elle offre l’hypothèse particulièrement attrayante d’une nouvelle application. Né à une époque où le juriste s’interroge sur les imperfections d’une législation qui se complexifie, l’abus semble tout particulièrement adapté pour s’appliquer dans des disciplines fortement réglementées et sujettes au changement, telle la propriété intellectuelle ; une matière dont on déplore régulièrement les dérives et les abus. Ce texte est la première partie d’un article publié en deux numéros.

The theory of the abuse of right is a legislation theory aimed at framing the application of rights prescribed by statute. The holder of a right is liable when a normally authorized act is animated by an intention to harm. This is the formula articulated in the Civil Code of Quebec which, in 1994, consecrated the principle of the abuse of right. The principle of responsibility underlying the abuse theory remains, however, problematic since the abuse theory targets activities which are a priori permitted by law. Indeed, the abuse theory allows courts to lift the immunity of the right-holder so that an act that conforms to the letter of the law becomes contrary to the spirit of the law — i.e., contrary to law. In this sense, abuse can be described as the “antenorm.” This principle of superlegality gives judicial power a prominent role: “par la jurisprudence, mais au-delà de la jurisprudence,” wrote Josserand. It is not a question of giving courts the power to make law but rather of avoiding the tyranny of rights, in exceptional circumstances. A study of the abuse of right must uncover the first movements of socializing thought at the beginning of the twentieth century. The asocial use of an individual right is abusive. The abuse theory must be placed in the context of a flourishing civilian doctrine that opposes the exegetic method and juridical subjectivism. The study of this doctrine is not of purely historical interest, as the doctrine may also offer a new application that is particularly attractive. Born at a time when jurists reflected on the imperfections of increasingly complex statutory law, the theory of the abuse of rights appears particularly suited to areas of law that are heavily regulated and subject to changes. One such example is intellectual property, whose excesses and abuses are often deplored. This text is the first part of an article published in two different issues.

Depuis l’avènement du multipartisme dans certains États africains, des crises plus ou moins violentes y agitent régulièrement la scène politique. Les désaccords entre les gouvernants et l’opposition créent un climat de tensions permanentes, débouchant quelquefois sur des confrontations armées d’une rare violence.

Les acteurs politiques africains recourent assez fréquemment à des accords et autres compromis pour sortir des crises nées de leurs désaccords. Ces arrangements politiques comportent souvent un contenu juridique destiné à pallier les insuffisances et les lacunes de la constitution, dont l’instrumentalisation par le pouvoir exécutif est l’une des causes du malaise des sociétés politiques africaines.

La relation entre la constitution et les conventions politiques en période de crise pose problème. Elle se révèle être une relation à la fois conflictuelle et pacifique, dont les manifestations dépendent des règles en présence. La grille de lecture de l’analyse constitutionnelle classique se trouve affectée par le caractère atypique de cette normativité constitutionnelle pénétrée par la politique. La pyramide des normes, en particulier, est bouleversée par ces accords politiques qui, dans certains cas, sont prioritaires par rapport à la constitution. Cette hétérodoxie normative, dans laquelle la norme constitutionnelle semble affaiblie, a néanmoins l’intérêt de favoriser parfois son enrichissement par la norme politique.

Since the advent of multi-partyism in different African states, violent crises regularly shake up the political scene. The rulers and the opposition are generally in disagreement, which creates an atmosphere of permanent tension, sometimes leading to armed confrontations of extraordinary violence.

To overcome their disputes, African political actors frequently have recourse to agreements and other compromises to end crises born of their disagreements. More and more, these political arrangements have legal content intended to make up for the inadequacies and lacunae of the constitution, whose use by the executive for its own ends is one of the causes of unrest in African political societies.

This raises the problem of the relation between the constitution and political agreements in times of crisis. Based on an analysis of various situations, we observe a relationship that is at once conflictual and peaceful, depending on the rules in place. This atypical penetration of constitutional normativity by politics affects the interpretive framework of traditional constitutional analysis. The pyramid of norms is also affected to the point where, in certain cases, political agreements take priority over the constitution. This normative heterodoxy, in which constitutional norms seem weakened, nevertheless has the benefit of sometimes being enriched by political norms.

Toward the end of the previous century, Canadians experienced an unprecedented period of constitutional activity involving changes and proposed changes to our constitution, three referendums, and a series of important court decisions. The patriation of the constitution of Canada was formally proclaimed in Canada on April 17, 1982. The new amending formula was tested in a series of constitutional negotiations. The two most prominent of the proposed amendments, the Meech Lake and Charlottetown Accords, although ultimately unsuccessful, had a very significant impact. A number of other, less extensive amendments were achieved with little controversy. In this lecture, as drafter of the proposed amendments and former legal advisor to the Government of Canada, I will look back on the drama of these events, paying particular attention to the context in which they took place, the different processes that were carried out, the events that were taking place in the backrooms, and the aftermath of some of these initiatives.

Vers la fin du siècle dernier, les Canadiens et Canadiennes ont vécu une période d’activité constitutionnelle sans précédent, incluant des changements effectifs et proposés à notre constitution, trois référendums et une série de décisions judiciaires importantes. Le rapatriement de la constitution du Canada a été formellement proclamé le 17 avril 1982. La nouvelle formule d’amendement a été mise à l’épreuve dans une série de négociations constitutionnelles. Les deux propositions d’amendement les plus proéminentes, les Accords du Lac Meech et de Charlottetown, ultimement sans succès, ont eu un impact significatif. Un certain nombre d’autres amendements, moins controversés, ont été réussis avec peu de bruit. Dans cette conférence, en tant que rédactrice des amendements proposés et ancienne conseillère juridique pour le Gouvernement du Canada, je reviendrai sur ces événements, portant particulièrement attention au contexte dans lequel ils eurent lieu, aux différents processus utilisés, aux événements se déroulant dans les coulisses et aux répercussions de certaines de ces initiatives.
